Liability Waiver, Release, and Indemnification Agreement
This Agreement applies to all individuals participating in events, programs, retreats, or activities at Bethany Beach Center associated with the group named above through calendar year 2026, including group leaders, participants, volunteers, and guests (collectively, the “Group”).
1. Assumption of Risk
Participants acknowledge that participation in events and activities at Bethany Beach Center may involve inherent risks, including but not limited to personal injury, illness, property damage, or loss arising from normal activities associated with group gatherings, lodging, food service, recreational use, weather conditions, and coastal environments. Bethany Beach Center does not review, approve or supervise the activities of the Group while on the premises of Bethany Beach Center. The Group is fully responsible for their activities beyond the lodging and food services provided by Bethany Beach Center.
Each participant voluntarily assumes all such risks, whether known or unknown, inherent or incidental, except to the extent caused by the gross negligence of Bethany Beach Center.
2. Release of Liability
To the fullest extent permitted by law, the Group, on behalf of itself and its participants, releases and discharges Bethany Beach Center; its management, employees, and volunteers; the Christian Church Capital Area including its affiliated churches, Board and its officers; and the Conference Center Management Committee and its members (collectively, the “Released Parties”) from any and all claims or liabilities arising from participation in activities or use of the facilities, except to the extent such claims result from the gross negligence of the Released Parties.
3. Indemnification by the Group
To the fullest extent permitted by law, the Group agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) (collectively, “Claims”) to the extent such Claims arise out of or result from the negligent acts or omissions of the Group or its participants, including failure to supervise participants, misuse of facilities, or violation of Center policies.
Nothing in this section shall be construed as a waiver of any defense available to the Group under applicable law.
4. Indemnification by Bethany Beach Center
To the fullest extent permitted by law, Bethany Beach Center agrees to indemnify, defend, and hold harmless the Group and its leaders, officers, employees, and volunteers from and against any and all Claims to the extent such Claims arise out of or result from the gross negligence of Bethany Beach Center in connection with the ownership, operation, or provision of its facilities.
Nothing in this section shall be construed as a waiver of any defense available to Bethany Beach Center under applicable law.
5. Minor Participants
The Group acknowledges that minors may be present during the event. The Group agrees that it is solely responsible for the supervision, conduct, and safety of all minor participants, including compliance with applicable child protection and supervision standards.
By signing this Agreement, the Group represents and warrants that it has obtained appropriate parental or legal guardian consent for all minors attending the event, including consent to participation, assumption of risk, and medical treatment as described herein.
6. Medical Authorization
In the event of illness or injury, the Group authorizes Bethany Beach Center staff to seek emergency medical treatment for any participant when immediate action is reasonably necessary. The Group agrees to be financially responsible for any medical care provided to its participants.
Bethany Beach Center assumes no responsibility for the quality or outcome of medical care provided by third-party medical professionals.
7. Insurance Acknowledgment
The Group acknowledges that Bethany Beach Center does not provide liability, medical, accident, or personal property insurance for participants. The Group is encouraged to maintain appropriate insurance coverage for its members, including health and liability insurance. Your Group may be asked to provide proof of Liability Insurance (such as a copy of the cover of the currently paid policy). Policies are available at a low-cost from providers such as "EventSured.com".
8. Weather and Emergency Conditions
The Group acknowledges that Bethany Beach Center maintains a separate, published Weather Cancellation and Refund Policy, which governs refunds, rescheduling, and cancellations related to weather or emergency conditions. By participating in the event, the Group agrees to be bound by that policy as published and in effect at the time of the event. The related policy is available here: bethanybeachcenter.org/refunds
9. Governing Law and Severability
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-laws principles.
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
10. Acknowledgment and Acceptance
By signing below, the Group representative certifies that they are authorized to bind the Group, have read and understand this Agreement, and agree to its terms on behalf of the Group and its participants.
